Terms of Service

Please read these Terms of Service carefully before subscribing to Sermon Creative. By subscribing and using the service, you agree to be bound by these terms. If you do not agree, do not subscribe.

01 Acceptance of terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (the subscribing church, organization, or individual, referred to as "you" or "Client") and Sermon Creative, operated by Spencer Moser, located in Des Moines, Iowa ("Sermon Creative," "we," "us," or "our").

By completing a subscription purchase, uploading materials to the dashboard, or receiving deliverables from Sermon Creative, you confirm that you have read, understood, and agree to these Terms in their entirety.

If you are accepting these Terms on behalf of a church or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

02 Description of service

Sermon Creative is a subscription-based content service that produces weekly content assets for churches based on sermon materials submitted by the client. The standard weekly deliverable package includes:

  • One sermon blog post (600-900 words, SEO-ready)
  • One designed midweek email for distribution to your congregation
  • Two social media posts with custom-designed graphics
  • One small group or Life Group discussion guide

All content is produced by the Sermon Creative human team based on materials you provide. We do not guarantee specific outcomes, including search engine rankings, congregation engagement, or social media performance.

Sermon Creative reserves the right to modify, update, or discontinue any feature of the service at any time with reasonable notice.

03 Subscription and billing

Sermon Creative is offered as a month-to-month subscription at the published rate of $999 per month. Pricing is subject to change with at least 30 days' written notice to active subscribers.

Your subscription begins on the date your payment is processed. Billing recurs monthly on that same calendar date. You authorize Sermon Creative (through its payment processor) to charge your payment method on each renewal date.

Payments are non-refundable once the billing period has begun and content production has commenced, except as expressly stated in these Terms or required by applicable law. If you believe a charge was made in error, contact us at spencer@sermoncreative.com within 7 days of the charge.

Failure to provide valid payment information or a failed payment may result in suspension or cancellation of your subscription and cessation of content delivery.

04 Your content and materials

To receive deliverables, you are responsible for uploading your sermon content each week through the Sermon Creative dashboard. This may include video recordings, audio files, written manuscripts, sermon notes, or outlines.

By submitting materials to Sermon Creative, you represent and warrant that:

  • You own or have the right to share all submitted materials
  • The materials do not infringe any third-party copyright, trademark, or other intellectual property rights
  • The materials do not contain any content that is unlawful, defamatory, or harmful

You retain full ownership of all materials you submit. Sermon Creative uses submitted materials solely for the purpose of producing your weekly content deliverables and will not distribute, sell, license, or use your sermon content for any other purpose.

We may retain copies of submitted materials and produced deliverables for internal quality assurance and production purposes. We do not publicly share your sermon recordings or manuscripts without your written consent.

05 Deliverables and intellectual property

Upon receipt of full payment for a given billing period, Sermon Creative assigns to you all intellectual property rights in the deliverables produced for that period, including the blog post, email copy, social post copy, social graphics, and discussion guide.

You are free to use, publish, modify, and distribute the deliverables for your church's ministry and communications purposes without restriction. You may not resell deliverables produced by Sermon Creative to other organizations as their original content.

Sermon Creative retains the right to reference the existence of our client relationships for portfolio and marketing purposes (for example, listing church names as clients), unless you request in writing that we keep your engagement confidential.

Any design templates, systems, tools, or processes used internally to produce deliverables remain the sole property of Sermon Creative.

06 Acceptable use

You agree not to use the Sermon Creative service or dashboard to:

  • Submit content that promotes violence, discrimination, or illegal activity
  • Misrepresent your identity or organizational affiliation
  • Attempt to gain unauthorized access to our systems, dashboard, or other clients' accounts
  • Use the service for any purpose other than producing content for your church or organization
  • Reverse-engineer, copy, or replicate our internal production processes or tooling

Sermon Creative reserves the right to terminate your subscription immediately and without refund if we determine, in our sole discretion, that you have violated these acceptable use provisions.

07 Revisions and delivery

Sermon Creative targets delivery of all weekly deliverables by Wednesday or Thursday, assuming sermon materials are uploaded to the dashboard by Monday morning of that week. Late uploads may result in delayed delivery.

Each weekly package includes one round of revisions per deliverable at no additional charge. Revisions must be requested within 7 days of receiving the deliverable. Revision requests should be specific and tied to accuracy, tone, or alignment with your church's voice. Revisions are not a mechanism for requesting entirely different content from what was produced.

Sermon Creative does not guarantee specific delivery dates and is not liable for delays caused by factors outside our reasonable control, including illness, technical outages, or natural disasters.

08 Cancellation and pausing

You may cancel your subscription at any time by contacting us at spencer@sermoncreative.com or through the subscription management portal. Cancellation takes effect at the end of your current billing period. You will continue to receive deliverables through the end of the period for which you have paid.

If you need to pause service (for example, during a summer sabbatical or sermon series break), contact us at least 5 business days before your next billing date. Paused periods are not eligible for partial refunds on billing periods already paid, but we will work with you to resume service at a convenient time.

Sermon Creative reserves the right to cancel any subscription at any time for any reason. In the event we cancel your subscription without cause, you will receive a prorated refund for any unused portion of your current billing period.

09 Disclaimers and limitation of liability

Sermon Creative provides the service "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that deliverables will meet any specific standard of theological accuracy beyond reasonable care and diligence.

The content produced by Sermon Creative is based on materials you submit and is intended to support your church's communications. It is not a substitute for pastoral oversight, theological review, or your own editorial judgment. You are solely responsible for reviewing and approving all content before publishing it.

To the maximum extent permitted by applicable law, Sermon Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, congregation, or reputation, arising out of or related to your use of the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the 3 months preceding the claim.

10 Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or your use of Sermon Creative shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in Des Moines, Iowa, under the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Sermon Creative.

11 Changes to these terms

Sermon Creative may update these Terms from time to time. When we make material changes, we will notify active subscribers via email at least 14 days before the changes take effect. Your continued use of the service after the effective date of updated Terms constitutes your acceptance of the new Terms.

The most current version of these Terms will always be available at sermoncreative.com/terms. We encourage you to review them periodically.
